Rex Homes Lead Program Terms and Conditions

By submitting your information and completing payment, you (“Contractor”) acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions with Rex Homes LLC, operating as Rex Homes Lead (“Company”).

1. Services Provided

Rex Homes Lead provides marketing and lead generation services that deliver customer inquiries (“Leads”) related to mold and/or water damage services.

Leads may be delivered via phone calls, SMS, email, CRM, or other communication methods.

2. No Guarantee of Results

Contractor understands and agrees that:

• Lead volume is not guaranteed

• Lead quality, accuracy, or intent is not guaranteed

• Rex Homes Lead does not guarantee closed jobs, revenue, profitability or return on investment

Leads are generated through marketing efforts and may vary in quality, responsiveness, and outcome. Contractor acknowledges that results depend on multiple factors outside the Company’s control, including but not limited to response time, sales ability, pricing, competition, geographic location, and market conditions.

Rex Homes Lead makes no representations or warranties regarding the performance of any lead and shall not be held responsible for any business outcomes resulting from the use of the service.

Contractor acknowledges that the purchase of leads is at their own risk.

All leads are considered delivered and fulfilled once transmitted to the Contractor through the Company’s system or designated communication method.

3. Fees & Billing

• Contractor agrees to pay all fees associated with the Program, including:

  • One-time setup/activation fees (if applicable)

  • Recurring subscription fees (e.g., monthly)

• Recurring charges will be billed automatically to the payment method on file until canceled in accordance with this Agreement.

• All payments are non-refundable once processed. No refunds, credits, or adjustments will be provided based on lead performance, quality, responsiveness, or

  outcome.

• Contractor acknowledges and agrees that services are considered rendered and fulfilled upon delivery of leads, regardless of the Contractor’s ability to convert such leads into customers or revenue.

• Contractor agrees not to dispute or initiate chargebacks for valid services rendered. Any disputes must be addressed directly with Rex Homes LLC operated by Rex Homes Lead in accordance with this Agreement.

• Failure to pay may result in immediate suspension or termination of service, without liability to the Company.

4. Cancellation Policy

• Contractor may cancel at any time

• Cancellation stops future billing only

• No refunds will be issued for prior charges

• Access to leads may be terminated immediately upon cancellation

5. Lead Usage & Contractor Responsibilities

Contractor agrees to:

• Respond to leads in a timely and professional manner

• Provide lawful, ethical, and compliant services

• Maintain all required licenses and insurance

• Not resell, share, or misuse leads

Rex Homes Lead is not responsible for Contractor performance or customer outcomes.

6. Independent Contractor Relationship

Contractor is an independent contractor and not an employee, partner, or agent of Rex Homes LLC operating as Rex Homes Lead. Nothing in this Agreement shall be deemed to create any partnership, joint venture, or employment relationship.

Contractor is solely responsible for:

• Services provided

• Customer interactions

• Business operations

7. Communications Consent

By signing up, Contractor consents to receive communications from Rex Homes LLC operated by Rex Homes Lead via:

• Phone

• SMS (text messages)

• Email

For purposes including:

• Lead delivery

• Account updates

• Billing and support

Message and data rates may apply. Message frequency may vary.

Contractor may opt out of SMS communications at any time by replying STOP. For help, reply HELP or contact support.

8. Limitation of Liability

Rex Homes LLC, operating as Rex Homes Lead, shall not be liable for:

• Lost profits, lost revenue, or missed business opportunities

• Disputes between Contractor and any lead, customer, or third party

• Any indirect, incidental, special, or consequential damages arising from the use of the services

Rex Homes Lead makes no representations or warranties, express or implied, regarding the performance, quality, or outcome of any leads or services provided.

To the maximum extent permitted by law, the total liability of Rex Homes LLC for any claim arising out of or relating to this Agreement or the services provided shall not exceed the total amount paid by the Contractor to the Company in the thirty (30) days preceding the event giving rise to the claim.

Contractor agrees that any claim must be brought individually and not as part of a class action.

9. Termination

Rex Homes Lead reserves the right to suspend or terminate Contractor access at any time for:

• Non-payment

• Misuse of leads

• Unprofessional conduct

• Violation of these terms

10. Modifications

Rex Homes Lead may update pricing, services, or terms at any time. Continued use of the service constitutes acceptance of any updates.

11. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes, claims, or controversies arising out of or relating to this Agreement or the services provided shall be resolved exclusively in the state or federal courts located within the State of Florida. Contractor hereby consents to the personal jurisdiction and venue of such courts.

Contractor agrees to first attempt to resolve any dispute informally by contacting Rex Homes LLC (operating as Rex Homes Lead) in writing prior to initiating any legal action.
